    KIKLIKO, Inc. – Copyright Policy (DMCA Compliance)

    KIKLIKO, Inc. ("Company") upholds and enforces a policy to address alleged copyright violations in accordance with the Digital Millennium Copyright Act (DMCA). If you believe that content hosted on or made available through our services infringes your copyright, please follow the procedures outlined below. Contact details for our Designated Agent for DMCA claims are provided at the end of this document.

    1. Submitting a Copyright Complaint:
    If you believe your copyrighted work is being used on our platform without authorization, you must submit a formal notice of claimed infringement including the following details:

    – A physical or digital signature of the individual authorized to act on behalf of the copyright holder;
    – A clear identification of the copyrighted work allegedly being infringed;
    – Sufficient detail about the specific material claimed to be infringing, including where it is located on our platform, to allow us to locate and assess it;
    – Contact information of the complaining party (including mailing address, phone number, and email, if available);
    – A good faith statement that the use of the content is unauthorized by the copyright owner, their agent, or the law; and
    – A statement, under penalty of perjury, that the information in the notice is accurate and that the complainant is authorized to act on behalf of the copyright owner.

    Upon receiving a properly formatted takedown request, KIKLIKO, Inc. will:
    – Remove or disable access to the material in question;
    – Notify the user responsible for the upload, when possible; and
    – Offer the user the opportunity to respond with a counter-notice (see below).

    2. Handling Repeat Infringement:
    KIKLIKO, Inc. maintains a policy to take appropriate action, including account termination, against users who are found to have repeatedly violated copyright laws. The threshold and criteria for determining a repeat infringer are at our sole discretion and based on factors such as the number and validity of notices received.

    3. Filing a Counter-Notice:
    If you believe that your content was removed in error or due to a misidentification, you may file a counter-notice by sending the following information to our Designated Agent:

    – Your physical or electronic signature;
    – Identification of the material that was removed and the URL/location where it appeared prior to removal;
    – A good faith statement explaining that you believe the content was removed due to mistake or misidentification;
    – Your name, physical address, phone number, and email (if applicable); and
    – A declaration consenting to the jurisdiction of the U.S. Federal District Court for the judicial district where you reside (or any district where KIKLIKO, Inc. operates if outside the U.S.), and agreeing to accept service of process from the person who submitted the original complaint.

    4. Reinstating Content:
    Once a valid counter-notice is received:
    – We will promptly share it with the original complainant;
    – The complainant will be informed that the content may be restored after 10 business days unless they inform us that a legal claim has been filed against the user;

    If no legal proceedings are initiated within this timeframe, KIKLIKO, Inc. may, at its discretion, restore the content.

    5. Jurisdiction Acknowledgment:
    By submitting either a takedown or counter-notice, you consent to jurisdiction as outlined above and agree to be bound by the legal obligations of such actions.

    6. DMCA Safe Harbor Notice:
    KIKLIKO, Inc. operates in compliance with the DMCA’s safe harbor provisions, which protect service providers from liability when they respond promptly to valid infringement notices.
